If your facility is an IE or IPC licensed facility, you will need to hold an up to date Environmental Liabilities Risk Assessment (ELRA) and/or Closure Restoration and Aftercare Management Plan (CRAMP)¹.

Most likely, depending on the date your licence was granted, your company will be required to prepare an ELRA once every three years and update your CRAMP annually. If your facility's processes and emissions on site have changed significantly, an updated ELRA and/or CRAMP may also be required. High risk facilities² are required to provide a suitable Financial Provision (FP) instrument to cover both the ELRA and CRAMP amounts identified in these assessments.

A guidance document on the EPA's current approach to environmental liabilities and financial provision was published in 2019 and sets out the obligations for IE and IPC licence holders. The EPA will no longer require non- high environmental risk facilities to complete an FP. However, the EPA will still expect a completed best practice assessment to retain financial provisions for potential environmental liabilities. Additionally, the EPA requires licensees to provide an annual statement of the facility's status to ELRA, CRAMP, and FP requirements as part of your company's Annual Environmental Report.
